1. Preamble

These Terms of Sale (in French: Conditions Générales de Vente, "CGV") govern Tronche! purchases (Premium plan, gallery extensions and photo packs) made through the Apple App Store and Google Play Store.

All prices are shown in euros, inclusive of tax (TTC). Prices may vary slightly depending on the region and the store used. Premium purchases and photo packs are one-time (non-recurring) purchases.

3. Purchase terms

Premium purchases, extensions and photo packs are available exclusively through:

Purchases are processed and billed by Apple or Google under their own terms and conditions. Tronche! does not have access to payment information.

4. Nature of purchases — non-recurring

Premium purchases, gallery extensions and photo packs are one-time consumable purchases, with no automatic renewal or subscription. No periodic charge is made.

Gallery extensions (+3 months) must be purchased before the gallery expires. Each extension extends the gallery by 3 months from the current expiry date (and not from the purchase date): successive extensions stack cumulatively. Once the gallery has expired, no further extension can be purchased and the photos are permanently deleted (see Terms of Use §9).

5. Right of withdrawal

In accordance with article L221-28 13° of the French Consumer Code (Code de la consommation), the right of withdrawal does not apply to digital content supplied immediately after purchase.

When making a purchase on the App Store or Google Play, you expressly waive your right of withdrawal and performance of the service begins immediately: credits are credited, the Premium plan is activated, or the gallery duration is extended.

Refund requests: Tronche! does not hold the payment (collected directly by Apple or Google) and cannot process a refund. Any request must be addressed to the relevant store, which applies its own commercial policy:

6. VAT

Karl Cosse benefits from the VAT exemption scheme (franchise en base de TVA) provided for in article 293 B of the French General Tax Code (Code général des impôts): « TVA non applicable, art. 293 B du CGI » (VAT not applicable, art. 293 B of the CGI). No VAT is invoiced directly by Tronche!.

For purchases made through the App Store and the Google Play Store, Apple Distribution International Ltd and Google Ireland Limited collect and remit the applicable VAT according to the buyer's location, in accordance with their own European tax obligations.

7. Price changes

Tronche! reserves the right to modify its prices at any time. Changes apply only to new purchases made after the price update — purchases already made are not affected retroactively.

8. Legal guarantee of conformity

The digital services and content supplied by Tronche! (Premium plan, extensions, photo packs) benefit from the legal guarantee of conformity (garantie légale de conformité) provided for in articles L224-25-12 et seq. of the French Consumer Code (Code de la consommation), which transpose EU Directive 2019/770 on digital content and services.

In the event of a lack of conformity, the consumer may request that the service be brought into conformity free of charge or, failing that, a price reduction or termination of the contract. The guarantee applies for the duration of the supply of the service.

9. Complaints

For any complaint relating to a purchase, please contact Apple or Google support as a priority, depending on the store used. For questions relating to the Tronche! service itself: [email protected]

10. Applicable law

These Terms of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the competent French courts will be seized.
